These Terms of Service ("Terms") govern your access to and use of the website glowads.agency (the "Site") and the paid advertising management (media buying) services on platforms including TikTok, Meta (Facebook/Instagram) and Google (the "Services") provided by Glow Dream LLC ("we", "us", "our"). By using the Site or purchasing a subscription, you agree to these Terms.

1. The Services

We provide paid advertising management (media buying) services on platforms including TikTok, Meta (Facebook/Instagram) and Google on a monthly subscription basis, as described on our pricing page. The specific scope of each plan is listed on the Site. We may reasonably adjust the way Services are delivered, provided the core value of your plan is maintained.

2. Subscriptions & Billing

• Subscriptions are billed monthly, in advance, in U.S. dollars (USD).
• Payments are processed by third-party payment processors such as Stripe.
• Your subscription renews automatically each month until cancelled.
• Prices may change; we will give you at least 14 days' notice before any price change takes effect, and changes apply only from your next billing cycle.

3. Cancellation

You may cancel your subscription at any time by emailing contact@glowads.agency. Cancellation takes effect at the end of the current billing period. There are no cancellation fees. See our Refund & Cancellation Policy for details on refunds.

4. Client Responsibilities

To enable us to deliver the Services, you agree to provide accurate information, timely feedback, and any required content, credentials, or account access. Delays in providing these may delay delivery. You confirm that any materials you provide do not infringe third-party rights.

5. Intellectual Property

You retain ownership of all content and materials you provide to us. Upon payment, you receive the right to use the deliverables we create for you for your business purposes. We retain the right to use general know-how, tools, and non-confidential techniques developed while providing the Services, and to display completed work in our portfolio unless you ask us not to.

6. Acceptable Use

You may not use the Services for any unlawful purpose, or to promote content that is fraudulent, defamatory, infringing, or otherwise prohibited by law or by the policies of relevant third-party platforms. We may refuse or discontinue service for projects that violate this section.

7. Third-Party Platforms

Some Services depend on third-party platforms (e.g., hosting providers, domain registrars, advertising platforms, search engines). We do not control these platforms and are not responsible for their actions, policy changes, outages, account decisions, or results. Fees you pay to third parties (such as advertising budgets) are separate from and not included in our subscription fees.

8. No Guarantee of Results

We will perform the Services with professional skill and care. However, outcomes such as search rankings, advertising performance, traffic, or revenue depend on many factors outside our control, and we do not guarantee any specific results.

9. Limitation of Liability

To the maximum extent permitted by law, Glow Dream LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim.

10. Warranty Disclaimer

Except as expressly stated in these Terms, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate the Services if you materially breach these Terms and fail to cure the breach within 7 days of notice, or if required by law. Upon termination, any unpaid amounts for Services already delivered become due.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Site or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
